Terms of Service
The agreement governing use of AROS.
1. The service
AROS is a commercial intelligence and revenue execution platform. It plans and runs marketing, prospecting and quality workflows on a customer's behalf, within limits the customer sets.
2. Accounts and access
Accounts are for people aged 18 or older. Each customer organisation controls its own users, roles and permissions. Access is per named user; credentials must not be shared. An administrator may suspend or remove access at any time, taking effect immediately.
3. Acceptable use
The service must not be used for unsolicited bulk messaging, unauthorised data scraping, circumventing another platform's access controls, or any unlawful purpose. The service must not be used to publish or upload content that infringes copyright or other intellectual property, and the customer warrants that it holds the rights to everything it publishes. On a valid notice AROS may take down a landing page it serves at a public address, and may take down its record of an external publication, as set out in the copyright and takedown policy. AROS refuses several of these in code, and the refusals are not a defect.
4. Autonomy and human decisions
AROS proposes; a human decides. At the default settings, publishing, sending and spending wait for explicit human approval. The customer sets each agent's autonomy level and may raise it. Actions classed CRITICAL, such as a production deployment, are never executed autonomously whatever the configuration, and actions classed high risk need approval unless the customer has set the agent to the self-optimizing level within budget bounds.
5. Customer data and ownership
The customer owns the data it puts into the service and the outputs generated for it. AROS does not sell customer data, and one customer's data is never made available to another.
6. Third-party services
Connected platforms (advertising, social, email, data providers) are governed by their own terms. AROS acts only within the access a customer explicitly authorises, and a capability with no credential runs only as a labelled simulation that touches no external account.
7. Fees, billing and taxes
Fees and the billing period are those set out in the customer's order or invoice. Applicable taxes, including GST, are charged at the rate in force on the invoice date and shown as a separate line on the invoice.
8. Availability and support
Target availability, planned maintenance and support response times are those agreed in the customer's order. Where the order sets no service level, the service is provided without an availability commitment, planned maintenance is announced in advance where practicable, and support is answered in the order in which requests arrive.
9. Suspension and termination
Either party may terminate in line with the order. Accounts of repeat infringers may be suspended or terminated. The customer may ask for an export of its data and for its deletion on termination; both are carried out on request, because no self-service export and no automated deletion on termination is built yet.
10. Liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct. Subject to that, neither party is liable for indirect or consequential loss, loss of profit or loss of business opportunity, and the total liability of AROS arising out of or in connection with these terms or the Data Processing Addendum, however it arises, is capped at the fees the customer paid in the 12 months before the event giving rise to the claim.
11. Changes and governing law
Changes to these terms are notified in the product or by email before they take effect, and a change that materially reduces the customer's rights may be refused by ending the agreement before it applies. These terms and the Data Processing Addendum are governed by the laws of India, and the courts at Chhatrapati Sambhajinagar, Maharashtra have exclusive jurisdiction over any dispute arising out of or in connection with them, except that either party may seek urgent relief in any court of competent jurisdiction. Notices of alleged infringement are handled under the copyright and takedown policy at /legal/dmca.
